For permanent jewelry services for minors (ages 10-17), a parent or legal guardian must be present and provide written consent.

  • Temporary storage in RAM is incidental to your accessing and viewing the website

Product and Service Terms

Permanent Jewelry Services

Service Description: Permanent jewelry involves welding custom-fitted chains, bracelets, anklets, or necklaces that have no clasp and are designed to be worn continuously.

Assumption of Risk: You acknowledge that permanent jewelry services involve the use of welding equipment and accept any risks associated with the service. While generally safe, you may feel slight warmth during the welding process.

Health and Safety: You must inform us of any metal allergies, skin sensitivities, medical conditions, or concerns before receiving permanent jewelry services. We are not liable for allergic reactions or complications arising from undisclosed conditions.

Removal and Durability: Permanent jewelry can be removed at any time by cutting the chain. We are not responsible for jewelry that breaks due to snagging, excessive force, normal wear and tear, or that needs to be removed for medical procedures, travel, or personal preference.

Handmade Custom Jewelry

Custom Orders: All custom jewelry orders are final sale. By placing a custom order, you acknowledge that the piece is made specifically for you and cannot be resold.

Product Variations: Each handmade piece is unique. Slight variations in color, size, texture, and design are natural characteristics of handmade items and are not considered defects.

Production Time: Custom orders typically take 2-4 weeks. We will provide an estimated completion date, but delays may occur due to material availability or unforeseen circumstances.

Private Events

Booking Requirements: A non-refundable deposit is required to secure your event date. The remaining balance is due on or before the event date as specified in your booking agreement.

Cancellations: Event cancellations are subject to our Cancellation Policy. Deposits are non-refundable.

Event Conditions: The host must provide adequate space, seating, lighting, and electrical access. We reserve the right to cancel or modify services if conditions are unsafe or unsuitable.

Limitation of Liability

DISCLAIMER OF WARRANTIES: OUR WEBSITE, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIGHT14 DESIGNS, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) our website or services
  • Any conduct or content of any third party on our website
  • Any content obtained from our website
  • Unauthorized access, use, or alteration of your transmissions or content
  • Allergic reactions, skin irritation, or other physical reactions to our products or services
  • Breakage, loss, or damage to permanent jewelry after it leaves our care
  • Delays in production or delivery of custom orders
  • Cancellation or rescheduling of events due to circumstances beyond our control

MAXIMUM LIABILITY: IN NO EVENT SHALL EIGHT14 DESIGNS, LLC'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO EIGHT14 DESIGNS IN THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

Indemnification

You agree to defend, indemnify, and hold harmless Eight14 Designs, LLC, its owners, employees, contractors, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your violation of any third-party rights, including intellectual property rights
  • Any harm caused to any third party as a result of your use of our website or services

Shipping and Delivery

For product orders, shipping costs and delivery times will be specified at checkout. We are not responsible for delays caused by shipping carriers or customs processing. Risk of loss and title for products pass to you upon delivery to the shipping carrier.

Returns and Refunds

Please refer to our Return Policy for detailed information about returns, exchanges, and refunds. Custom and personalized items are final sale and not eligible for return or refund except in cases of defect or error on our part.

Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.

Entire Agreement

These Terms, together with our Privacy Policy, Return Policy, and Cancellation Policy, constitute the entire agreement between you and Eight14 Designs regarding your use of our website and services and supersede all prior agreements and understandings.

Waiver

No waiver by Eight14 Designs of any term or condition outlined in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.
